I/we understand that the overhead expenses of the academy do not diminish with the departure of some athletes during the course of a year and that my obligation to pay the fees on time for the full academic year as stated in this contract by The Eastern Elite CHAOS Hockey Academy. I/we further understand that no portion of such fees so paid or outstanding will be refunded or cancelled notwithstanding the absence, withdrawal, suspension, government mandated closures or dismissal of the above student. The Academy reserves the right to withhold information until student’s account is paid in full. Force Majeure-Frustrated The Eastern Elite CHAOS Hockey Academy may at times alter, change or modify their athletic or any part of the program due to times of crisis or revisions. Refunds will not be granted in connection with, and the payment obligations set out hereunder will not be suspended or terminated in the event of, any temporary suspension or cancellation of The Eastern Elite CHAOS Hockey Academy and any related services that result from an emergency, force majeure, or other exigency. The Eastern Elite CHAOS Hockey Academy assumes no responsibility for failure to perform Hockey Team Program services due to emergency, force majeure, or other exigency. For the purpose of this contract, the term “force majeure” shall mean fire, earthquake, flood, strikes, work stoppages or other labor disturbances, riots or civil commotions, litigation, war or other act of any foreign nation, plague, pandemics, epidemics or other public health emergencies (including those resulting from diseases, influenzas and other viruses) and actions or powers of any governmental agency or authority (including quarantines, business closures and travel restrictions relating to public health emergencies and or governments), or any other cause like or unlike any cause mentioned above, which is beyond the control or authority of The Eastern Elite CHAOS Hockey Academy. It is understood that if an athlete leaves the academy for seven consecutive days other than holiday time, she is deemed to have been withdrawn from EECHA. It is also understood that any athlete who misses or refuses to participate in our daily/weekly/weekend program without a valid doctors note or misses more than 8 scheduled games and/or training sessions per month other than time dictated by EECHA will risk dismissal. I/we are fully aware and have read the athlete handbook and players agreement I/we are in agreement with the rules and policies of EECHA. I/we agree to pay, to the extent permitted by law, the academy’s expenses of enforcement and collection of the fees and related expenses, including both penalty interest on unpaid balances at the rate of (3%) per month until the amount is paid in full, and without limitation, reasonable attorney’s fees and costs. I/we understand that the academy reserves the right to dismiss the athlete from the program if any payment is not made in accordance with the payment specified above.
